I have a problem with the people who live below me in a split level house. About two months ago I was losing sleep due to loud music that was being played excessively loud all night(until 6am). I thought they were just having weekend parties until it continued all week.
At first I just went downstairs and asked them to turn it off. The person I talked to said he would have his roommate turn it off, which he did--until 3am that night it was even louder than before. Since then I have asked them nicely twice, and called the police on them several times. It continues to go on.
I am going to the landlord soon to ask them to either evict the people below me or let me out of the lease agreement with no penalties. I have been told by friends that the landlord has an obligation to maintain liveable conditions and that the excessive noise would constitute an unliveable condition, since it forces me to sleep at my girlfriend's and friend's houses. Does anyone know what kind of legal recourse I have in this situation, and also I'd like to know what I should know going to my landlord with this problem. I've generally not had horrible problems with them before, but this is more serious than any problem I've brought to them before. All help is greatly appreciated.

Where are the police reports, return receipt requested Certified Letters , or phone log messages to the landlord to back this up?

Have something to back it up when contacting the LL , or taking it to Court .
