i have a 1 year lease on an apt. in vancouver, washington. the person who lives above me is noisy at all hours of the night (loud enough to be heard through earplugs with a pillow over my head). the apartment manager says they cannot ask him to stop his normal daily living activities, so she won't even ask him to try to be quieter. i asked her to let me move into a new apartment, but she says it will cost an additional $150.00. I don't have the ability to pay the fee, and the lack of sleep is making my living conditions unliveable. Do I have any recourse?

Have you talked to this jerkass yourself? If you haven't already, try it, but be careful. My problems with the (insert bad word here) downstairs neighbors got completely out of control because of our complaints about their noise. Long story...if talking to him doesn't work, call the police(try to time it so they arrive at the height of his/her noise), more than one complaint should convince your jerk landlord that your lease has been broken(read it)and he should either be required to move you to a quiter apt. or maybe not be paid for your place.
