My roommate and I live in N.C. We rent a 2nd floor apartment. The 3 young guys under us play music loud enough that furniture shakes at all hours of day & night. We spoke to them and no change. We complained to apt manager 4x and she said that we must call police because there is nothing they can do but send them notice of a complaint. Lease rules state that if electronics are loud enough that neighbors can hear them that it's "too loud and will not be tolerated". We called police last night along with their next door neighbor ( found out from officer) and they said they can give tham a ticket but that's all.
My question is can we break lease without a cash penalty? Is it leagal? Can we insist that apartment company pay for the movers since they refuse to take action? I'd appreciate input.

well if you have only complained once to the police and to the manager 4 times then i would give written notice to both the disruptive tenent and to the manager. specify to both parties that several complaints have already been made and still the problem persists again IN WRITING specify that according to your lease this will not be tolerated. at this point either the tenent will stop ifyou would like to proceed and move then give notice of when you are moving and why. but at this point the manager will not be liable for you moving or paying for you to move and i do not believe that he will be.the only thing you have to worry about is breaching your contract (lease) if you want to move in which you would have to go to court and state that you did complain several times and did give ample time and notice for this behavior to cease and that they never corrected the problem
