My wife, daughter and I live in a downstairs apartment in San Antonio Tx. We love the complex except for our very noisy upstairs neighbors, they are very bad. They constantly have numerous people in the dwelling and are stomping around and running and such. My question is what are our rights as far as having them moved, breaking our lease or getting an immediate move by the landlord. And how should we proceed. Thank You

First YOU have to document the noise, by calling the police and filing a complaint, even if its everyday... then send a letter certified mail return reciept the landlord that you intend for the landlord to take action against the tenant, if not then it would be considered by you a violation of the lease.

If they have numerous people in during the normal hours then probabaly not much can be done....but if they have lots of people over at midnight and you have to get up at 5 am to go to work, thats different.

Have you talked to them? Do they have carpeting in their apartment? in some leases you must have 80% of the floors carpeted, at the tenants expense.
