What is the name of your state (only U.S. law)? California

Can a 501c3 non profit send text messages SMS to phones legally if the person has not given consent? What if the non profit gives an option to opt out? What if it is for the purpose of asking for a donation or informing? The FCC has stated on their website that non- commercial businesses can send text messages with oral consent. How would anyone track that? Any info is much appreciated

Sending unwanted texts as a way to solicit donations is a sure-fire way to incur the wrath of those who might otherwise think about donating to a cause, and is a good way to generate a lot of bad publicity for the non-profit organization (not to mention it violates the TCPA and the CAN-SPAM Act).
