I have an agreement with my employer which has a non compete clause and a 2 years service clause, i.e. I should work with the employer for 2 years. Thereafter if both parties are agreeable it can be further extended. If I breach these, I have to pay $20000 + Employer's Lawyer's expences in case of litigation. I have worked with the current Employer for 6 months.
My employer did not pay during bench period, is not paying me agreed salary and also, the Employer is not paying my Health Insurance as agreed, does never pays me on time. The Employer generally delays the Salary by 1 month to 2 months.
The Employer owes me $25000 in arrears.
I have offers from other Employers who are my employer's clients and they do not have non compete clause in their agreement with my employer.
I am in 2 minds: I very much want to go to the new Employer. But I am worried if my Current employer goes to court what will happen?
Can anybody help me with advice?

Thanks in Advance.

No one here can comment on the enforceability of an agreement they have not read. The only advice we can give you is to show the agreement to a local attorney.
