Non-Compete and Lay-off

Are non-compete and confidentiality agreements still valid if layed-off from employer?

Without reading it, it would be tough for us to say... however, typically, non competes and confidentiality agreements survive a layoff.

Having said that... most companies that have laid off an employee won't chase you for finding work... but that is certainly not a hard and fast rule.

I assumed the confidentiality holds, but my thought on the non-compete was that being laid off through no fault of my own keeps me somewhat free of any constraints about working for competitors. I did not get a severance payment to keep you from working for a competitor, and I thought once you are laid off, all previous contract restrictions become void - they usually only apply if you voluntarily leave the organization.

But you are right, I am sure they will not chase me either :)

most non compete contracts (as i now them) are there so you do not steal their customers. So don't go out on your own and 'bid' places that you know are theirs *and if you do start a business in the same field don't do it in their area* I don't think working with someone else will be an issues unless you go after their customers. Also look at the contract and see exactly what it says about that.
