Non-compete question

I'm currently working for a consulting firm that has an non-compete agreement that states I cannot work for any firm I contract at for 18 months after termination of the contract.

The company I am on contract with is soon to be acquired by another firm. To the best of my knowledge, the non-compete does not include any language regarding client mergers and acquisitions.

Can I use the following course of action with out fear of legal recourse from my current employer?
1) resign my current position
2) wait for the merger
3) become an independent contractor at the merged firm. Is this considered a new legal entity?

I don't know what you are trying to accomplish. If you are trying to continue working at that same place, why would you want to quit?

Generally speaking the merging company inherits all contracts and liabilities of the company it just acquired, including non-compete agreements of contract employees.
