Non Competition Section in Contract?

Hello, I live in NY.

I wrote an instructional book for a large publisher.

In the contract, under "Non-Competion," it said that I cannot write any competing books, videos, or audios on the same topic.

However, I had them add an addendum (which we both signed) saying that the author's self published works do not apply to the non competition section.

MY QUESTION: If I self publish my own book/video course on the same topic and then sell the rights to the website with the book/video course, would that be breaking the contract?

If your contract did not spell that out, you may find yourself in a bind. Perhaps the only way to get the most accurate answer would be from you giving it a try and them taking you to civil court over it. At the very least, you should sit down with an actual attorney so he can read over your contract, so that he can see the actual language used, and give you the best insight possible.

These contracts are always tricky to see if they are unenforceable. Take it to an attny & have him examine what it says and what you want to do. Hopefully, he can give you some case law that supports his opinion.
