Just closed on PA home. Prior to inspection owners replaced free standing oil tank in basment. Through agent said "tank was aging, premptive replacement". Our house inspector noted some smell of oil under new tank but said new tank looked good. Oil smell in basement didn't fade in 2 weeks of ownership so we called oil company who stated " Tank was replaced because a previous buyers inspector had discovered it leaking, we tested, found small leak." We have subsequently removed a small section of concrete floor and found that the concrete is soaked with oil along with subslab material.
Gets better. Oil clean up company arrives to give us an estimate on correction. See's we have boxes on basement flooor and suggest we move them. Says he was in our basement with the Seller's listing agent 2 month earlier to discuss why the basement flooded (through the frenchdrains) when it rained.

Neither of these items were disclosed. In fact the basment was declared "dry". A declaration the listing agent touted.

Have to believe seller and listing agent(agency) have been party to fraud.True? Home inspection shouldn't be a game of hide and seek!

This definitely should have been disclosed.
