I am in Michigan. My ex and I were never married. We have a 10 year old child together. After 4 years of parting ways, I am now engaged and need to move 35 miles away from my ex. We have somewhat "shared" custody for the past 4 years. We haven't gone through the court at all. I have had the child more often however, and have been the "primary" parent. Problem is, my ex does not want his son to move 35 miles away with me. What can I do to make this legal? The child wants to live with me, but he also wants to see his dad. Do I file for custody? I have no lawyer yet.

well i am not a lawyer, but i am a parent of two. will you be moving in the same county, because i know legally you only have to stay in the same county as the child was born in or that you live in now. plus i mean if it is only 35 miles away why couldn't his fater see him everyday? if his father really wants to see him he will drive 35 miles.

It will be in a different county. Yes, it is only 35 miles away, and there is no reason that he couldn't drive over to see him, but he is quite unreasonable about the whole thing and tells me that it should be HIM that has our son full time and I should be the part time parent.
