I recently listed a horse trailer on Ebay. I had a buyer for the trailer at $4500. In my instructions on the the listing included the buyer must make a $500 dollar deposit which was to be made 48hrs after the auction had ended and the remaining payment had to be paid within 10 days following the end of the auction.

I got an email from the gentleman who purchased the trailer saying he would not be able to get pay the deposit until Monday (72 hrs after end of auction). I would be ok with that. Tuesday, no deposit. I call the buyer, he appoligized and said that he would get the money soon. He offered Western Union, but Ebay doesn't recommend this form of payment and I stated in the auction that I accepted Paypal. He said that he would sign up for the Paypal account and get me the money as soon as possible. By Thursday, there was no deposit. I sent him an invoice through Paypal. Saturday I tried to contact him by phone, left a message, no call back. Monday, I call again, he tells me he is too busy to talk. I tell him that this matter needs to be taken care of and that he can call me at work all day Monday to discuss when he gets a free moment. He doesn't call back. I have submited a dispute claim with Ebay to have my listing fee refunded. This gives the buyer 7 days to respond/make payment before I am reinbursed the listing fees.

If I relist this trailer on Ebay and I don't get at least $4500, can I sue him for the remaining amount plus court costs? What is the name of your state?

Sure, but you'll have to travel to his state to do so.

Only live 2 hours away from non-payer, same state

Traveling isn't an issue. I'm only about 2 hrs away from the county he lives in. We both live in Michigan
