What is the name of your state (only U.S. law)? MN

I have a landscape services company that does seasonal lawn care and snow removal.

Costumer owns three properties that we did work for the past summer. Absolutly refuses to pay oustanding bills, Says he doesn't have the money.

What are my options, first of all protect myself from him filling BK, and secondly get him to pay in a reasonable amount of time

Here's what I've already tried.
1. Talked with him multiple time and tried to get him to commit to scheudled payments, he won't do it...
2. Had a personal friend that is an attorney make several phone calls, now he doesn't take his calls either.
3. Mechanics lein, does this give me protection in the event he files BK
4. Small claims court, To slow, but would give me a judgement. Don't know how this changes anything, He is not disputing the charges. Just doesn't pay.
5. Can I file a criminal complaint and have him arrested. The bill is fairly substantial and I would love to see this guy in cuffs.

Go to small claims court.

And have a business law attorney review the contract/agreement you ask your customers to sign. In the future you should ask for a deposit upfront.
