Non U.S. Citizen adopting step child

My fiance and I have been together for 3 years now. We weren't planning on getting married until a year from now, but due to the ambiguity in the whole adoption process we have been suggested to go ahead and get married through the JP in order to speed this along.

My son is now 7 years old, the father has never been in his life, he used to pay the bare minimum the state allowed for him to pay in child support, but it has now been one year since his last $60/bi weekly child support payment. I have not heard from him in years, I have no idea where he lives, he has never shown any interest in getting to know his son. Is there any way that we can go to court to terminate his parental rights in order for my fiance to be able to adopt him? Also, my fiance is from Germany, he's here on a work visa. Will this be a problem with the adoption process? Do we have to wait until he's a U.S. Citizen or can he still adopt him as the step parent as a resident? Does he need to be a permanent resident before he can adopt him?

You need to get married before he can adopt, and once you get married, permanent residency will be easy. You should get a lawyer for the adoption; it is a complicated process and not really for do-it-yourselfers.
