need legal advice on modification
We currently live in Hawaii, we are in the process of finding out info on getting information on modifying custody of my husbands 10 year old daughter. We are in the military. My husband in the noncustodial parent and ex is the custodial parent. The reason we want to take her to court for custody is because she cannot provide a stable living environment for his daughter. In the last few years his daughter has probably attended 15 different schools in about 5 different states. The child has witnessed the custodial parent being beaten by her spouse. The custodial parent has taken the kids into several victims violence shelters but always goes back to her husband. Now you may feel that she is a victim at this point but the truth is she has violent lashes of anger. Years ago during my husbands divorce to her she was diagnosed with a borderline personality disorder. I don't know if that has anything to do with anything. She has according to her mother that wants us to get custody, been living off of the system since she moved out. My husband went on a remote tour for a year, during that year the custodial parent and her spouse went on semi truck routes with 3 kids and a dog for 5 months. They lived in the truck with no address supposively to save money. During this time I still sent her Packages to her maternal grandmother. I guess she got them when they rolled into town. When my husband got back from his remote we got in contact with custodial parent and set up communications again with his daughter. That lasted for about 2 months then all of the sudden phone was cut off, letter sent was returned with no forwarding address. We called maternal grandmother and found out that they had coaught a bus and moved to another state. We do not know where they are and the custodial parent hasn't called. We did find out that supposively her spouse was extradicted to Wyoming for outstanding warrants. And she moved from AL to UT. I can think of 5 different states that they have lived in. We live in HI and she hasn't lived any address more than 6 months and don't know how to define the jurisdiction. She has had several CPS complaints but she is always running. Now we don't know where she is and the whole time his daughter feels that he doesn't love her because he doesn't maintain contact but we cannot find them. The maternal grandmother told us that she got a call from her that stated that she thought that they were trying to take her kids away and they would never see their grandkids again. The maternal grandparents are worried about the kids and are willing to help us get custody but I don't know where to start with jurisdiction and if we have a case for modification etc..and we can't find her. Help?
