We were in the process of purchasing a home is Southern California and found out that there is additional space that has not been disclosed.
**A: I presume this space is an improvement with no building permit.
Was it a hidden basement or something? Or the area was disclosed but the fact that the area was illegal was not disclosed?

**R: Yes, you are correct they enlarged the kitchen without permits and did not disclose this to us.
We informed them we no longer wanted to purchase the home. When our Realtor found this out she stopped representing us because she no longer would be making her commision and she was working out of her normal area and did not want to help us find a new home. She said she felt she diserved her commision on this house and would do nothing to stop the sale from going thru. Hence we are stuck trying to figure out where do we go from here.
**A: send a certified rrr letter to the Realtor requesting help again and
give a deadline. Then if no action, file a complaint with the real estate licensing office.
This person has violated numerous provisions of state law and Realtor ethics.

**R: We sent a complaint in today to the Department of Real Estate against our Real estate agent and the sellers. Our agent for not representing our best interests when she was informed of the discrepancies and the Sellers agent for not working in good faith because we have tried several times to contact him over the phone, fax, and by mail. He simply is not responding leaving us hanging. It has been 4 weeks since we started this process.
We have tried dealing with the Sellers agent and the Escrow company both are not dealing with us because we are not the real estate agent. Help!!!!!!!!
**A: what? There is no law that states that in order for a real estate agent or escrow to deal with you, you have to be a real estate agent. Send the lisitng agent a letter that your so called Realtor has left you hanging and is refusing to help you, therefore you must speak to them directly.
And as far as escrow is concerned, tell them if they do not help, they will have to answer to the State regulators.
