we have lived in a 2 fam. house in nj for almost 14 yrs. rent has never been raised. we have have been resp. for basic upkeep, landlord paying for major repairs. he became ill and son took over. he lives in ca. took one tour of house, not seen since (3 yrs.ago) all repairs needed to be done showed to him- nothing.major problems with leaks, pipes exploding, l.l. contacted - nothing . we suffered major loss of pers. prop. out of pocket exp. stopped paying rent to recoup losses, now he wants back rent. what can we do? he has contacted a laywer.

So lets get this straight.....you have not had your rent raised in 14 years.....YOU spent every last dime on yourselves, YOU didnt have renters insurance at $20 a month or less...

And NOW you withold rent to Try and recoup your "losses"

INGRATES you are....time to look for a new place to live.

OR get on you hands and knees and BEG.. REALLY BEG..the son not to evict you.... And thank him for having such a wondeful father ,and you had some problems lateley, and were not thinking correctly, and you wish to pay everything you OWE him, plus his LEGAL FEES... and you will send it FED EX overnight mail, and hope that you both can put this behind you.

YOU ARE THIS CLOSE TO KILLING THE GOOSE THAT LAID THE GOLDEN EGG..(YOUR CHEAP RENT)

obviously you are a slumlord or you are just someone who likes to spout off. i did not give all the facts. my rent was not raised because we took care of the property as if it was our own,we made repairs (within reason at our expense) with the hope and prospect of purchasing. This house has had no insurance (totally illegal) also we just found out that because all the elec. and plumbing is substandard and the roof must be replaced, no one will insure my landlord. Our agreement was with the father, no signed lease, just a handshake.so now our deal with the father is null and void. in 3 years the son has let the house go. Fair is fair. I don't feel we owe him back rent. we only did not pay for the amt. that we lost. if he had ins. he could recoup his losses. renters ins. is optional. homeowners is not we have put plenty of $ into our home. the house is over 100 yrs. old. mary hartman we are hard working , honest, moral people trying to work with someone who only sees this property as a weight around his neck we see it as home.

You are going to evicted witha 30 day notice ANY DAY NOW and you want to talk to me like that....

Boy are you in for a shock......

IT IS NOT YOUR HOME..you dont own it.....YOU made repairs on that place in exchange for lower rent...and that was fine for 14 years...AND DONT EXPECT ANY OF IT BACK, a judge will say it is part of the monthly rent.

Now you lost a few items, and you were too cheap to have renters insurance, and WHO CARES if he didnt have homeowners...it wouldnt cover your losses anyway.

It sounds like you havent saved a dime in 14 years, or you would NOT act this way, figuing it was your stupid mistake not to protect your property. And considering how much money you SHOULD have saved the loss would NOT be a good enough reason to withold rent and force the son to evict you...

YOU have NO RIGHT withold rent.....
so PAY THE SON TOMORROW OR start packin!

PS I would agree with you one ONE condition if you applied to at least 3 insurance companies to get renters insurance and they all sent you a letter in writng that you were refused becuase there was no homeowners insurance..THEN and ONLY THEN would witholding the rent be a reasonable excuse.

you are so out of it mary hartman!!! If you were injured or property of yours was damaged on someone else's property would you sue their ins co or your own? think about it. actually i do have a case, and you have no idea what you are talking about! i honestly hope no one that reads your replies takes you seriously and considers your info to be legit. are you practicing law or are you a member of the bar? because i would love to kow what state issued YOU a license

You dont get it....YOUR PERSONAL property is YOUR responsibility, and YOU didnt protect it.

Accidents are a TOTALLY diferent matter.

YOUR insurance company would sue his insurance company to recoup the loss...OOPS no insurance company, then the SON would have to pay YOUR insurance company back for YOUR LOSS. and you would have a place to live....
