I own a home in N.C. I live in Georgia. I have been unable to travel to N.C. to check on the property and my tenant. He has been having a hard time paying rent and we have been more than patient. He is now almost three months past due and we are having to have them move out in thirty days as we cannot continue to carry the mortgage without rent. Can you tell me what law governs the state of N.C. so that I do not do anything illegal or harmful to this tenant?

North carolina law governs the state of North carolina. Look it up using the tab at the top of the page marked "state Resources".

I think that you were very foolish to wait so long. You will probably lose at least 3 months rent.

The first few times I had to do an eviction, I hired an attorney who does nothing but evictions. I watched what he did, asked a lot of questions, and photocopied his forms, so I could learn how to do it myself.
