I live in Brooklyn, New York and I rent an apartment for over 11 years without a lease. The landlords daughter has an grudge against me and she wants me to live but her father is the landlord. Do she have any rights to say anything? This is the second month that she isn't accepting my rent check. When I give them the rent check, I also enclose a letter stating this "I, the undersigned, have received the monthly rent check in the amount of $ for tenant (myself) on the first of February 2001. I have willingly refused the payment and returned the check to tenant on February 2, 2001 for the following reason: We no longer wish to have tenant as a tenant and want her to leave the premises. Then at the bottom of the paper I have a space for signature for the Landlord and for myself. He refuses to sign because he said that his daughter is the one who rents and takes care of the money. But she will not sign the letter either.The landlord said to me that he doesn't know what to do. Please advise what my next step should be.

NO the daughter has NO right to evict you, UNLESS her name is on the lease which you dont have one, or on the DEED to the house, or if she has been appointed guardian of her father because he's very sick.

If she OWNS part of the house, she is considered a lanldord, then she can try and evict you, but if daddy shows up in court with you, the judge will toss this one out the door.

Not accepting my rent check

Thank you very much for your response back, DjDJ. I know for a fact that her name isn't on the Deed nor is she appointed guardian for her father because the father is healthy. She intimidate her father. Also her name isn't on the Deed partically. Again, thank you for your response.
