when my mother passed away i was surprised to find that her will was over thirty years old. she left my brother and sister as co-executors. between the two they may have half a brain. they insist we keep the land but have made no effort to help raise the money needed for the debts. they expect me to do this. my brother can not even be bothered to help clean out the house. my mother died in june and the estate is still not even in probate. do i have any legal recourse ? i'd prefer not to destroy the family over this but their bumbling is ruining my life. before her death she stated that she wanted the house to go to my daughter, her first grandchild. is this considered a verbal will ? thanks !

What does the WILL say about who gets the house? What she said verbally has no bearing and will not stand up in court.

The executors have to add up the total value of the estate to see whether it is large enough to require probate. Because land and home ownership is involved, probate is a certainty because the new heirs will have to be legally determined.

Let's hope the executors are smart enough to hire a probate attorney for advice about how to proceed in handling this estate.
