This is going to be long winded, sorry in advance...
I bought a new car in May of 2007. Since then I have had problem after problem with the car. In September 07 it was taken to the dealer for several problems, bad rotors, rear defogger not working properly, gas door not popping open when lever pulled and spots of rust appearing on the body of the car. They replaced the rotors but dismissed all of the other things. They said the rust was dirt, there was nothing worng with the defogger and I was closing the gas door improperly. The same problems were still happening so I brought the car back in. This time they re painted my trunk lid where there was rust but said it was not rust there was dirt in the paint & replaced the rear window. They still stuck to the story that I was closing the gas door incorrectly. Over the last few months I continue to have trouble with the gas door, the heater goes cold when I stop at a light, the transmission gets stuck in a higher gear intermittenly, and there is water entering the trunk causing mold & rust to develop there. I have an appointment on tuesday for them to fix these problems. I doubt that they will take care of them all. I know Lemon law says that the same thing has to occur 3 times. Is there a law that protects someone in my case? Tuesdays trip will be the 3rd time for rust but they have never admitted that there was rust so would it fall under lemon law? I took pictures but they don't do it justice. I tried writing a letter to the eastern regional manager for Kia & got brushed off. I also tried getting them to trade me out of this car for the same monthly payment only to be told it was not possible. I'm really frustrated & appreciate any advice.What is the name of your state?

If you think under lemon laws you will get all your money back, you are sorely mistaken. They will charge you cents per mile, depreciation and any wear and tear. Just for example, a new Cadillac (bought when new) with now, 22,000 miles on it,... they will charge .18 per mile, in other words knock off $3,960 to start, plus..., but a new Malibu might be .28 per mile. The lower dollar the car stickers for, the higher the cent's will be.

Go to another dealer and get the car fixed.

I am aware of the fact that I'm not going to get all my money back, I've been driving the car for almost a year. I never mentioned getting a refund. There is no other dealer within an hours drive from me. My ? was if there was some law to protect me from a defective car & possibly having to pay for these problems when the warranty is up.

warranty is up, means NO warranty. You pay for repairs like everyone else does who's warranty is up.

You exceeded the mileage, right? 3years 36k, Is that correct?

Don't you have the usual 100k miles rust warranty?

the car is still under warranty & is not even close to having 10,000 miles on it my ? is...IS THERE A LAW THAT PROTECTS CONSUMERS FROM HAVING TO TAKE TIME OUT OF THIER LIFE TO CONTINUOUSLY FIX PROBLEMS OTHER THAN THE LEMON LAW? It is ridiculous that I have to be without a car for these repairs.

1. Call KIA kia.com/ownersPage.php for a zone rep or what ever KIA calls them! (explain to the rep who will intercede on your behalf)

2. Have the dealer put you in a rental (at their costs) (you should have 5 days of rental under warranty.

3. Ideally you want the KIA rep to look at the car, before & after it's fixed, meaning before you pick it up.

This is your best bet.
