I live in CA. I just moved all my belonging to my new apt and am cleaning my old apt today. I gave a 30 day notice which ends at midnight tonight.

I was just called up this morning at my new apt by my old manager, he advised that the carpet guys had come to take a look at the carpet to give an estimate on the cost for cleaning the apt. He said that they were there and would be entering. I said that I had not given 24 hour notice, he said that they were there right now. I said, "ok". He said all right, and hung up. I spoke with my new manager who said to call the manager back and tell him not to enter, that he needed 24 hour notice. I called back and got his fax machine, I called the owner of the property to query about this, she said that they wouldn't be entering today, but tomorrow, after the apt had been vacated. I immediately drove over to my old apt, and found that the carpet guys and the manager had just left the apt.

What sort of position am I in? I am cleaning the apt, but wonder if I should, since I could hold this over them, and threaten a lawsuit if they don't give me back my complete deposit. Is this the case?

The manager also told me as he was going back to his apt that the cleaning people would probably be over later tonight after we do the walkthrough to start cleaning.

Anyone who could help it would be appreciated, I really don't know where I stand or what I should do.

They probably have someone moving in tomorrow, so the carpets must be clean today,

How to defend yourself.........

Thats easy........

Go to a k mart or any other store and get 2 or 3 disposable cameras and take lots of pictures, BEFORE you hand back the keys.

Make sure you have a reciept for the carpet cleaners you hired or the steam cleaner you rented.

PS most notices end at 5pm not at midnight, just for this occasion where the landlord has his crew come in tonight and clean up. So they wont lose any rent.

So, does it not matter that they didn't give me a 24 hour notice before entering? Is that a law that isn't really enforced and shouldn't really matter or be brought to anyone's attention if broken?

No you are moving out they need to inspect, and you shouldnt have anything of value there anyway...

You always move your most expensive stuff out of the apartment first!

OHH..ok, so since I'm moving out, all rights given to me by law are null and void. Gotcha. And FYI, my new apt didn't have blinds at the time I started moving, so in that case I don't think anyone would've moved the expensive equipment in first. :D
