Please, someone, answer me by tomorrow nite....I live in Ohio and have sent my landlord a 30 day notice. He is currently looking at several thousand dollars of repairs to the apt I am renting due to the fact that my son has gotten lead poisoning from it and he has been notified that I have a lawyer. I sent him a 30 day notice stating that I would be moving from the apt by April 1st, he and I discussed the fact that I am not just moving into another apt, I am moving into a home that my brother rents now, but he is in the process of buying another home. My question would be, can my landlord force me out based on the fact that I wrote him a 30 day notice, even though the property I am moving to has not become available yet? I would still pay April rent and would look for him to prorate upon my leaving. What can he do to me if I'm not gone by the date that I indicated on my 30 day notice?

Without knowing anything about Ohio law, I would guess that the answer is Yes.

If you don't leave on time, he can probably evict you.

Where do you people get this DUMB IDEA you can pro rate the rent?

YOU pay rent monthly PERIOD!

You owe the whole month PERIOD!

Most parts of the country it is not likely you will find tenants to rush into an apartment in the middle of the month... SO YOU want the landlord to lose rent ON YOU?

If you ar NOT gone on that day he can start eviction proceedings in court and you would owe rent his legal fees and costs....

BUT here is the best part..IF he has people coming in to fix the place and you are there YOU would be liable and will have to pay the penalties for not starting on time..All the workers salaries etc, renting machinery

That could be thousands of dollars, if the contractors are busy and cant do it for a couple of weeks. Then who will pay the landord the lost rent? YOU WILL!!!.. so move into a hotel room and store stuff in your brothers basement garage etc,
