Not My Mother, Only Dad

I am 13 years old and my parents have joint custody of me. My mother’s apartment is my primary residence. I want to live with dad but my mother won’t let me. I have felt this way since I was 4 years old. Back then my mother had sole custody of me. I remember my dad telling me, “Breana, it is time to go, I have to bring you to your mom’s apartment.” And I remember crying and crying because I did not want to go to her apartment. At my mothers house I have an older sister who has a different dad than me. My mother usually has a new boyfriend every month at least and I am sick of her having them over to spend the night. They spend the night every night and if they have kids, they spend the night too. Her priorities are her boyfriends, her cloths, and her tanning (Any thing that makes her look better). My dad is and has been married for the past 8 years. I love my step mom. She makes sure I am clothed properly and I have enough food. My mother never goes by the court papers.

Ø I have no cloths to wear there (accept summer pants and caprice, but it has been below 0 degree weather).
Ø She never picks me up on time.
Ø There is never any thing to eat there.
Ø She fights with my dad for holidays, even though she knows that holiday belongs to my dad.
Ø My mom did not consult my dad before making my religion catholic.

These are all things that are against our custody orders. My dad and step mom however, do all the things they are supposed to do.

> I have good clothes to wear and I am always being asked if they still fit, exc.
> My dad is always on time or early.
> I always have food to eat.
> My dad goes by th court orders for everything, including holidays.
> My dad consults my mother before big decision making.

These all go by the court orders. When I am at my mothers apartment she is either sleeping or is gone some where with her boy friend.

My dad tried to take my mother back to court When I was 9 years old. He got joint custody.

This is why I don’t want to live with my mother. These things have a big affect on my life. Please help me. I need to live with my father.

By the way some one sent a reply saying that he/she doesn't think I am 13 years old. I am 13 years old, but because of all of the nonsense in my life, I have been forced to be more mature. Also, one of the only stable things in my life has been school, so I have studied hard and am more intellectual then the avarage 13 year old.

You can't do a thing in the legal situation to change custody. Only your father can. So, I would suggest that you sit down with him and ask why he hasn't attempted to file a petition to change custody.

*Why* do I have the feeling that this ain't a 13 yo kid posting? Maybe because I HAVE 13 yo kid - and a very bright one - and this just doesn't have the right feel.

So fess up - who's really posting, pretending to be the kid?
