My husband was employed in a full time position with a doctor's office with approximately 20 employees. Since he left the employment, he has been made aware that all other full-time regular employees were offered compensation in lieu of health insurance benefits to cover premiums for private insurance. This was paid in addition to salary or hourly wages. He was never offered this benefit or informed of the practice. He was employed with the doctor for five years. Is there a case for discrimination, for lack of a better word, or can he now recover what was not offered? jeep12

If he were in a class of employees that were eligible for benefits, and he was not offered them, then he might have had a case. However, since the law does not require payment of compensation for waiving insurance, I see no legal recourse.
