On the night of 8/14/09 my boyfriend began to argue with me when I wanted to take my son and I home. He swung at me and missed, I fell on the couch and he jumped on top of me. I was able to dodge his punches, but could not get him off of me, he is 6'1" and 200lbs. I was very scared for myself and our 6year old son. So not knowing what else to do I burned my BF in the face with a lit cigarette to get him off of me..I then called the police and he took the phone and hung it up. I quickly grabbed my son and jumped into my vehicle...the police called back and i told them the situation. While waiting for the police in my vehicle with my son, my BF came out of the house and was punching and kicking my vehicle...to say the least i was terrified. I waited almost 10 min for the police to show during that time BF was punching yelling and screaming while we were locked in the car. Iwas scared so i left. When i got home i drank a 40oz corona to calm my nerves and went to walk the dog..20 min later here comes the police. They placed me under arrest for DV simple assault, DWI, Refusal, wreckless driving and Dwi with a minor. I had told the arresting officer that i had drank when i got home....where do i stand? I have received e-mails from my now exboyfriend stating that he should have killed me and snapped my neck...i was the victim and because he showed marks i was arrested.On paper I seem like the aggressor, when all i was doing was protecting myself. I WILL be seeking legal council. i will be getting a TRO on monday. Any input will be greatly appreciated!!

Update

All the charges in this case were dropped. The police did not have probable cause to question me about DWI 1. because i was not operating my vehicle when the police showed up at my house (it was parked and locked in my driveway) 2. The police did not witness me break any traffic laws.(therefore no Probable Cause to question me about my driving) My ex has been charged with simple assault DV and con tempt of court for lying about the whole situation that night. He really screwed himself into a corner while on the witness stand. To the 2 people who posted on this thread..F-U try helping people instead of putting them down when asking you idiots for advice.
