What is the name of your state (only U.S. law)? Arizona
I was a sales rep working out of my home in Mesa, Arizona for a company in Michigan selling leads to dealerships for approx. 6 months. I recieved a check each month for reoccuring business however I never received one in October. I asked the owner when he would be sending a check out to me. He stated that he wasnt paying me since I had 2 dealers in collections and my commission that I earned wouldnt cover the chargebacks. I reminded him that I signed an agreement that specifically stated that I would be advanced commission on the first 10 dealerships that I signed with no chargebacks. He then said "when I get paid, you will get paid". Of course, I had no copies of invoices so it would be impossible for me to try to collect any money from dealers anyway. Thirty minutes after I asked about getting paid, they sent me an email terminating our agreement. They currently owe me $5950 however the owner said that he only owed me $851.50 and if I agreed to that then that would be considered payment in full and he would overnight a check to me which he did. However, I havent cashed it yet because I was told that if I did then I had no recourse in collecting the rest of my commission that is owed to me. I really need to find an attorney to help me collect the rest of my money but Im not sure if it would be better to find one in Michigan or Arizona since the agreement that I signed doesnt state which state law would apply. If anyone knows of a good AZ attorney that handles sales representative contracts, please let me know ... I would appreciate it!! The sooner the better too!
