My employer has a rule, that if you take a sick leave of less than 2 weeks before resigning, then they will not pay for the sick leave.
Is this legal?

Generally speaking, yes, this might be legal. There is no law in California even requiring that an employer offer sick leave benefits.

However, if you are an exempt employee, there may be an issue with docking your pay if you have a day off sick, since the company has plan to replace your regular pay with sick pay and you have sick hours available.
