My employer pays me once a month, the 25th for the entire month. They company has failed to meet payroll! I am an employee at will. Is this considered a breach of employment? Should I come into work the 1st of the next month or simply consider this to be termination of employment.

Company missed payroll

Failure to pay is a breach of the employment contract and of state and federal law; however, it is not a termination of your employment. Just as they can fire you at will, you can quit any time you want, so you need not reason for leaving if you want to.

As far as getting paid is concerned, you should immediately file a complaint with your state department of labor or employment.
