On Christmas Eve I was on my way to the airport to pick up a relative. I saw a gas station/mini-mart/car wash open and decided I had just enough time to get my car washed. I parked and went inside the mini-mart to pay for the wash and get the remote access code for the wash kiosk. I entered the washed and stopped at the appropriate spot when the red light came on. The carriage for the wash moved toward the front of my car and caught my passenger side (RH)outside mirror and broke the mirror. I allowed the wash to continue it's cycle and exited when the green light came on. I parked at mini-mart and got out to inspect the damage and notify the attendant inside. I had him look at the damage and we noticed a thick green chemical on the door below the mirror. The attendant reasured me it was only the soap from the wash and that it would just wash off. At that point he brought my attention to the little notice on the sales receipt that says "Due to the variety & conditions of vehicles, owner cannot be responsible for damage, including paint and or finish". When I got home from the airport an hour later and tried to wash off the green film, the color of my paint went with it. My white door is now 60% streaked in beige. How can someone get permits, open a business, collect monies, and then claim no responsibility for damages? The replacement mirror for my 99 Tahoe is $360 and to repaint the door will be another $400.
Since they were clever enough to insert the disclaimer and I was naive enough to give them my business, am I just out of luck or is this worth further pursuit?
