I closed on a house in southern IL at the end of October. When we closed on the house there was 35 1200# round bales on the property. I need some of the hay to feed my horses over the winter. At close we had the previous owner sign a paper saying that we (the buyers) could use the bales. Now, two months later the farmer who had cut and baled the hay shows up and wants to take his bales. According to him the previous owner, showed up at his door step a week before we closed and wanted her money for the round bales, which he paid her.

I am in a jam, the farmer had planned on feeding the bales to his animals and is need of them, while I need some, I do not need 35. What are my options.

I think you need to buy some hay to feed your horses. Maybe the farmer who bought & baled the round bales will consider selling you some.

I'm not an attorney, but I own a horsefarm in PA and I think the farmer has a right to that hay he bought and farmed. But if you befriend him now, next year, maybe you can work out a deal with him . . . where you split costs, labor & hay.

As for the previous owner's agreement that you can use the hay . . . maybe one of the attorney's in the forum can advise.
