I recently went to family court with my ex-wife over the fact that I drink beer on the weekends that I have visitation with my 10-year-old son (which I didn't think was illegal). It is an issue that was first brought up a couple of years ago. The judge at that time ordered no drinking/drugs while I had my son. I admit it was stupid on my part to break the order, but I felt like I was doing nothing wrong. My son's stepfather also drinks beer and whiskey at home, so I'm not sure why I can't. I do have a DUI on my record from when I was 22 years old. But my wife also had a DUI; she's not innocent either. She claims that I place him in "immediate danger" by doing so.
Anyway, the most recent issue is drug abuse. Six months ago, my son found a tobacco pipe at my house and told my ex. She filed a motion in court just last month, saying my son has witnessed "drug abuse" and found "drug paraphenelia." These are both untrue. However, the court ruled that I have to take 3 random drug tests, and my overnight visitations have been suspended.
While I was married to my ex, I did sometimes use drugs. I assume that's why she automatically thought I was guilty of something. I have not done drugs in years and will gladly take the tests to prove her wrong. This has hurt and embarrassed me deeply. I am not sure if this is slander because of my past. I have never been arrested for drugs.
I mainly just want her to leave me alone. I have faithfully paid child support and seen my son regularly over six years. If I pass all three drug tests, would I then have a case of slander because it would prove that I don't do drugs?
