I have a hearing date coming up. It is for a motion to hear child support modification. The original petition was continued due to the ncp not having income info. Ncp was ordered to provide financial info and hasn't. I have updated all of my financial info and still have not received ncp's. How long does ncp have before the hearing to file? I have a feeling that, as it's happened before, the ncp will once again show up with no info and the hearing will be continued AGAIN. This has happened several times. Can/should I file a motion for contempt or motion to compel so that there is a little added pressure to provide the info? I am doing this pro se, I simply do not have the funds to pay an atty. Any experience with this is appreciated.

Our judge called his employer and accountant while we were in court and requested the info be faxed then and there.

Thanks. It's just very frustrating. He tends to job hop a lot, so the financials that ARE filed are very much out of date. It just stinks that IF we can get the copies faxed over, it wastes MY time and doesn't really allow an opportunity to verify anything.

If he doesn't provide the information again this time, when you do appear, make sure you mention how many times he's done this already. The judge most likely will compel him to supply the information on his/her own (without you having to file anything). Also, as a reminder, make sure tax returns are provided; not just pay stubs. In the meantime, have you at least been assigned a temporary amount of support until financials are verified?
