Does an attorney have to file a Notice of Appearance to appear at a civil proceeding at the Civil Court of New York City? If so, where can I find the NY law governing such a requirement?
If the defedant's attorney fails to file a Notice of Appearance, can one argue the defendant is not represented and the attorney is not eligible to appear on behalf of his client?
Can an attorney be sanctioned for not filing a Notice of Appearance?
I am in an awkward situation in which the defendant's attorney is playing games. He has relentlessly stated to the Courts on multiple proceedings he is appearing on behalf of an associate due to scheduling conflicts. However, there is no records of an attorney on the clerk's files of the Defendant being represented. Secondly, the attorney stated he was an associate of a law firm. When I contacted the law firm, however, no attorney exists.
Lastly, the defendant's attorney stated his client initiated a claim with his insurer and released my information to his insurer. He refused to release his insurer's information. Can the defedant release my personal information - including SSN - to his insurer and refuse to document such a claim? Can I request the Court to demand the release of his insurer's information and claim documents? I did not receive any communications from his insurance carrier. I am trying to figure out if his attorney is lying in court. If he is insured, can I sue his insurer?
In such a case, what should I do?
