I have a deadline of 2/15/05 to file a Notice of Intent to Lien a construction project for non-payment of materials delivered to project according to Section 53.053 of the Property Code for the State of Texas. I have filed this type of lien for private construction projects with no problems. However, I have been told that I cannot file a materialmen's lien on a Muncipal Utility District (MUD) project. If this is true, is the only protection I have would be to file a claim with the bonding company?
