I rent an apartment to a husband and wife that are in their 70's. They have one of their adult children, adult grandchild and two grandchildren that are 5 & 6 yrs living with them. In the past I have given the couple a letter concerning their child and adult grandchild using drugs on the property. There was another issue where one of their family members that does not live on the property came to the property with a gun and threaten to use it on one of their sons. To night, the adult son had an argument with a lady that does not live on the property. She left the property but he came out of the apartment with a weapon and threaten other tenants with it. The police was called and he was arrested.

The adult son is listed on the lease with his parents. I know I have grounds to evict them but my question is:

Do I have to give them a 30 day notice to leave the property or can I give them a 3 day notice to leave the property since the son has threaten other tenants that live on the property?

There is a section in their lease that states: The occupant agrees to use and occupy the premises in a safe, proper and sanitary manner. The resident shall not use any part of the premises for any noisy, disorderly, unlawful or immoral purpose or in any manner offensive to the neighbors or for any purpose deemed hazardous by the owner. It also says: Resident(s) shall not commit or permit any act, which will unreasonably interfer with the rights, comforts or convenience of others. Resident(s) is responsible for complete control of themself, their children and any visitors coming to see them.

I would like to give them the notice to leave tomorrow (Sunday).

Your description suggests that they have breached their contract with you, and they become nuisance and a threat to their neighbors. Nothing would prevent you from evicting them immediately. You may have to consider a restraining order from the court as well to prevent them from getting any close to the property.

Dee make sure you re read your states laws about evictions and notices (look in your state govt web page for landlord tenant ) or perhaps you can find info in MrLandlord.com last thing Some places do not allow sunday service of eviction notices IF you cannot find out wether a sunday service is legal then wait till monday .

Check the Ohio Residential LT act to see if there are any laws about shortening the notice period for certain types of illegal activity. Common activities that justify a 3-5 day notice and move out period are: drug use on the property, assaulting the LL, assaulting another tenant, intentionally damaging LL's property. Usually, LL has to be able to prove that T committed the illegal behavior. Arrest reports are useful for this. Follow whatever steps are outlined in the statutes and start evicting the guy.
