How much time are you required to give notice to landlord before moving? 30 days???? Lease was signed 4 1/2 years ago and lasted 1 year. Never signed another one... Thanks in advance...

Does your lease say that it renewed for a whole year at a time ? or does it say that the original term just expired back then and mentions no set term for continuing ?? review your lease , the answer should be there .

To expand on what Farmer told you, if there is no automatic renewal clause in your original lease then upon it's expiration it reverts to a month to month tenancy which requires a 30-day notice effective on the next date the rent is due and 30 days thereafter.

Thank you both. Now, what can happen if the 30 day notice is not given? For example...Rent is due on the 1st...Say the notice is given on May 12th to be out by June 1st...legaly...what can landlord do? For example...can he charge you for June rent? Thanks again?

If rent is due the 1st and notice is given on the 12th then yes, 30 days MEANS 30 days. That means that you are responsible for pro-rated rent for the time rent is due until the 30 days is lapsed.

So if it is prorated then he can not charge you for the WHOLE months rent, only half a months rent since it would be almost 2 weeks into the month? Am I reading that right?

Jane If your state requires WHOLE rental period of notice you owe for WHOLE month , if your state allows proper notice but the time clock to start once its mailed then its pro rated , search your state govt web page LL & tenant links to learn the difference .
