What is the name of your state (only U.S. law)? I'm in Illinois. My question is...my father owns a home that has a small amount of money owed on it. He was forced to go to a nursing home. I currently have it up for sale. The nursing home said that i have to give them his SS and his pension. He is approved by medicaid. Now do i pay the bills for the house and hopefully sell it quick or do i let it go into forcloser and give the nursing home his SS and pension. i know what i should do but what do i have to do legally.

Sell the house for fair market value. Pay the outstanding mortgage. Use remainder to pay for your fathers care. And use her pension and social security to pay for his care.

You don't have a choice about giving them his social security and pension. It goes directly to them, your father will be given about $40 a month for incidentals. If your father has been put on Medicaid, this is not your choice to make, even if you manage his money. They take everything he gets for the rest of his life. If you sell the house, you will have to use any profits you make on the house to pay for his medical care.

He has a home equity loan to pay plus a supplement medical bill and of course the gas,electric...etc. Do i forget about all of that and let the house go?

They'll be getting his checks if he is already in the nursing home and already on Medicaid. It will start going directly to them very soon if it hasn't already. Ask the nursing home social worker for advice, they will be very up on how this all works, are quite expert at getting things paid for by Medicaid for their patients.

In my opinion sold this house in a market value. If you are not interested to sale this house, than to-let this house for rent and the given money all is activity you can earned use to your father's proper treatment and better living.
