I was charged with a DWI last October because they said i refused to blow, i blew apparently it wasn't good enough. That being said, i have never received any notice from the DMV regarding a refusal hearing. I know i am lucky and shouldn't push it but i''m wondering how long do they have to pursue the hearing. I've plead to a DWAI over a month ago and don't want this other issue hanging over my head

The court itself should have issued you the date as part of the arraignment and it would have been scheduled within 14 days of your arraignment.

I know but the judge didn't do that, he didn't even ask for my license. My attorney said sometimes these things just fall thru the cracks.
