I have 2 questions; here's #1: My ex-husband is considering giving up his parental rights. My current
husband wants to adopt my son & we need to know what the law requires for my husband to legally adopt my son. What does the State of NY require, and where do we get the necessary paperwork? Can we do this without a lawyer? If there is any other information that we need to know, please include that with your response. Here's #2 question: My ex-husband is not a good father - to make a long story short, he had my son from April until September & from June until September did not allow my son to contact me & he was living in a homeless shelter for part of the Summer & all of the things that my current husband & I bought for my son was either sold, pawned or ruined because of my ex-husband. Also,I found out from the DSS that most of the houses that my ex had been living in since our divorce were not fit to live in, let alone have a child live there, too & my ex husbands current wife has 7 kids which I found out have been in-and-out of trouble. My ex is separated from her now & she is filing for divorce, but I want to keep my ex from my son because I do not think he is mentally able to have the responsibility to care for my son the way he should. He refuses to work & has been moving around just to keep from being homeless. How do I keep my son from him & how do I recover compensation for all of my sons things since he doesn't have them? (I have taken my ex to Family court to gain full custody - they are requiring us to be seen & evaluated by a psychaitrist) & neither Support nor family court will deal with the replacement of the $3000+ worth of things my ex sold or gave away or ruined! I would think that's a matter of support since the only thing he returned my son with was the disgusting clothes on his back & he won't admit that any of those things that he had have been lost. I am very tired of trying to get the court to agree that my ex is unfit to be a father, even though that's what the birth certificate says. My son is very happy with us & just wants to get this over with - he hates going to the shrink because he says he doesn't have a problem - which is very true - my son will accept either getting to see his dad or not. My son did tell one of his father's step sons that he hates his dad - can't blame him! My son will not admit that he would be happpier having my husband for a dad - what kid would?
