For 13 years I have paid child support without ever having a court order to
do so. I actually paid $8,000 above over the past years. I have two
children, 15 & 18.
I also carry medical insurance on them through my employer.
Everything had gone smoothly until the past year. My ex wife, her new spouse
and our daughter decided on college, applied for the loans and never
informed until after the fact. Keep in mind that college was never addressed
in our divorce decree. They applied for these loans based on their houshold
income. The ex wife's new spouse makes $30,000 dollars more a year than I do
and the ability to repay this is based upon their income. I found out about
all of this when my ex wife called my new wife and demanded $17,000 for
college. At this point I tried to get my daughter to go to a more affordable
school that offered the same education. We looked up financial aid and
grants, even offered her to come to NC and live with us to go to school. All
was declined. My daughter states that she is "too smart for community
college" but the truth of the matter the college that she chose is based on
her boyfriend being near by.
Now, the Judge has ordered me to pay child support for 2 children and part
of college. Basicly I am paying room and board for the same child twice. The
court has taken so much that I only have between $128-$140 left per week to
live on. I buy gas and about $88.00 worth of groceries. I can not help pay
the mortgage, or anything else. I feel that I should have had a say in
this...I am the father but my rights were taken away on this. I can not
afford to even come see my children for Christmas which again makes me feel
violated.
My ex wife did not disclose all of her assets, income, ect.
I really need help in this matter. I can't afford what is being done to
me...Don't I deserve to have a home, food, electricity?
It is also in our decree that I am to claim one child as a dependent which
she refuses to allow.
Any help you can offer would be greatly appreciated.
