Hi, this is regarding New York City. I have just started to recieve unemployment insurance (the max which is approx $405 a week), however, I am now working in an independent contracting job. I want to know what is the best way to handle this, and recieve the most money without getting into legal trouble.

The job will pay twice a month (every other week). According to my understanding, under New york state law, you can't claim unemployment for any week in which either 1) you worked more than 3 days or 2)earned more than $405 that week. The checks that I will recieve bi-monthly will will be for 400-1000 (it is a commision based that's why it isn't set). Now, I asked my employer, and she said that they won't monitor or designate the hours I work. I just need to talk to her twice a week. So, would I be able to claim full unemployment one week, then not claim it the following week in which I recieved my check? So basically, I can act as if the check is only for that particular week, and not two weeks. They can't technically refute this right?

A little about the job, in case it is relevant. I will go to locations in the city and collect "leads" from stationed boxes. These leads are for a prominent gym and potential members. If someone signs up, I get a commision, however; not to be recieved till weeks later.
