NYC Street cleaning parking ticket.

What is the name of your state (only U.S. law)? NJ

Ok so i got a parking ticket in NYC for alternate side parking while waiting for the time that is ok to park on the street. Parking regulation is No parking between 8:30am to 10am for street cleaning. At 9:55am while waiting outside my rental car a traffic cop gave me a ticket for not waiting inside my car. There are several cars waiting as well but I was the only one waiting outside with my doors open. The traffic cop did not care and gave me the ticket anyway.

One things i noticed in the ticket is that the Plate Type she put is PAS = Passenger while the rental car that i am using have a commercial plate on it. Isn't this supposed to be COM and can be used to get the ticket dismissed? Will the rental company receive this summon if I wait since the Plate Type is COM and not PAS? What kind of defense i can use if i decided to fight this ticket?

Any advice regarding this ticket is greatly appreciated.

The rental company will get the ticket, pay it, and charge your credit card. You're really not going to have a say in it.

That's NOT what you got a ticket for. There is no such offense. :rolleyes:

The passenger vs commercial thing won't matter. If you don't pay the ticket then it will accumulate penalties and you'll have to pay it anyway, as Zigner pointed out.

If you were inside the car it would still be "parking." You don't get any credit for being in the car or having the motor running. The only place this matters is next to a fire hydrant.

Your rental car, regardless of the plates on it, is not a COMMERCIAL vehicle as far as NYC is concerned. There's a specific defintion beyond the plates (must not be a passenger carrying vehicle, must have the company name on the door, etc...).

Absolutely true but I have seen that many traffic agents will not write occupied vehicles. I'm guessing it's to avoid getting into confrontations with angry drivers.

I know I've gotten into a lot of them over the years, but at least I have the power to write them a criminal summons or arrest them.

I've not heard of one getting a ticket for street sweeping while attended, but I've certainly seen lots of people show up here having been written up for other violations (notably double parking while hovering on a car pulling from a space) while attended.

Sure, not saying it doesn't happen, but I used to do a lot of enforcement in areas with a lot of traffic agents and I would very often see them just walk right past cars illegally parked with someone in the driver's seat. I would then go over and pick up the slack... ;)
