On June 22, 1998,I was granted a judgment against two unmarried individuals through small claims court in the amount of $5,000 in regards to medical expenses incurred due to their pit bull attack. We agreed to payments of $125 a month of which I received several full payments, dwindling down and finally ceasing in August 2000. I now have received Notice of Chapter 7 being filed by one of the individuals in Maryland. Can I personally file a letter of request that my debt not be discharged? Chances of my ever totally collecting is obviously slim to nothing, but it is a matter of responsibility, which I feel should not be released. Thanks for any assistance.

Sorry, but the basis of the judgment does not appear to fall under any of the allowed exemptions to discharge. Simply, this means that though you could file a request to exempt the debt, the court would likely not grant it.

I would suggest you aggressively pursue the judgment against the remaining debtor.
