I posted once before and got the answer I was looking for. The problem And question i have now is that since my seperation agreement has been signed and notorized BUT has NOT gone into court am i obligated to abide by what is in there? I know that i am not legally seperated but are either my husband or i obligated to do what is in the papers? I am in Virginia

My response:

No, you are not obligated - yet. The only time either party would be obligated is when that agreement is taken to court, reviewed by a judge, and the judge signs the final orders that would convert that Marital Settlement Agreement into a judgment.

When one of the parties feels that there has been a breach of the agreement, either party "can run to the Family court" and have that MSA converted to a judgment. So, be careful.
