What is the name of your state? Illinois.

My significant other is an only child. He came back home to his mother in the early 90's to take care of his mother. His father had remarried, and lived in California. He had received a birthday card from his father in '92, and that is the last that he heard from him. I told my s/o that we should do some investigating, such as the SS Death Index to see if something had happened to him. Well, we found out that his dad had passed away in the Fall of '92. His wife did not notify my s/o, although she knew where he lived, because she had previously lived in this very town. Wasn't she supposed to notify my s/o of his father's passing? It's not the money - but there are precious items that his dad would have had, family items, that he would like to know the whereabouts. This woman that he had remarried had a very bad reputation in this town - years ago she was accused of killing her husband, but got off the charge because of not enough evidence, thus her leaving here and going to CA. His father followed her there, and that's why he ended up in California. Is there anything that we can do about this? Or is there ANYTHING that we can do?

Well, I just wanted to know if "legally" he should have been notified of the death of his father?

I know of no law requiring anyone to inform anyone else about a death.

That would be kind of hard to enforce wouldn't it....

There is no legal obligation to notify anyone of another's death. If the party was named as a beneficiary in a will or trust, then it is more likely that legal notification would take place if an effort was made to find the party's current residential address.
