I think the basic point of my question is, can a legal obligation be established without the consent and/or acknowledgement of all parties?
You know those little blurbs you see at the bottom of some e-mails or faxes stating something like "This is intended only for the named recipients, if you receive this communication in error you may not forward it to a third party, and it's confidential so you have to either destroy it or send it back..." etc.
Does that automatically create a legal obligation on the part of the recipient who is just sitting at her desk minding her own business and suddenly gets a competing firm's marketing strategy or confidential price list, or whatever?
I'm asking because my boss wants me to format all outgoing e-mail to include something like this. Of course I will, but I'm just curious as to whether it really accomplishes anything.What is the name of your state?
