Odd tenant situation

What is the name of your state (only U.S. law)? Massachusetts

My uncle originally rented my grandfather’s house to “John” during a probate process. During the tenancy “John” had his mom and younger sibling’s move in. ( without permission) then at some point “John” moved out leaving his mother and 2 siblings renting the house.

Since “John” was always the one dropping off the rent it was never questioned until my uncle through other sources found out John had built a house and moved with his girlfriend.

So now where do we stand? The original one year lease is up with “John” and we want to go to a monthly rental agreement so that neither is locked in, in case we decide to sell the house...rent is current so there is no issue there.

Does the tenant have rights even though we never really rented to her? Can we just give her the paperwork and say either sign or get out? Can we just boot her or do we have to go through the eviction processes…would it be considered Squatters Rights?

I don’t think I could get him on a lease violation Subletting the unit because I don’t believe he made money on her living there he just wasn’t up front with us about her taking the house over.

You can present the current residents with a month to month lease and tell them they have 30 days to sign or move. If they don't do either, you have to go through the legal eviction process to get them out.
