Odds of collecting suport are worse than odds of winning the lottery

What is the name of your state? AZ

My ex does not work. He is not disabled. He is 42 and lives with mommy and daddy. He Pays nothing for room and board. Mom buys his clothes and pays all utilities. He has already lost his drivers license because he was driving on a suspended one. He hardly leaves the city let alone the country. He owns no tangible property in his name everything is in his parents name. He hasn't made a support payment since he pais a $1000 purge in June of 2001 and before that he made one cs payment of $105.00 then quit his job when they took that. In march of this year I once again completed the paperwork for contempt. My case is just now going to the state attorney general with the petition for contempt and the state wants to put a lein on him for arrears. My question is this. How long will the lein process take? He owns nothing in his name so I know it will not work. The real issue is this Is my daughter's chance at receiving support worse than the odds of winning the lottery? The only way I see my ex as ever paying is if by some off the wall chance that he wins the lottery and the state confiscates his winnings. My child is nine I have a few hundred in savings for her but it wont even cover a years worth of tuition for college for her and she is halfway there. Why is the state wasting time with a lein instead of taking some other action to get him to pay support? I know I'm rambling and I apologize . I am just so frustrated. :(

CP's pull the same crap (refuse to work & is not disabled, although collecting disability), just so they can *try* to get the maximum amount of support. I know they pull this crap because the biomom of my kids is doing this. What a shock she WILL be in next week in court!

The state putting a lien against him is probably standard procedure. How long it will take is impossible for any of us to tell you. You'd probably get a better answer by talking to them. Since he doesn't own property, what else do you expect the state to do? Do you expect them to throw him in jail? What does that do (that's worthwhile to help the child)? There is only so much the state is able to do.

If you're scrapping that badly, you might want to prioritize that savings for college. While it's nice to want to start saving for college now, providing clothing, food and other essentials for the child comes first. College is not "an essential" at age 9.

As frustrating as it is, there are people on both sides of the fence who "work"/abuse the system. If a person is that hell bent on avoiding paying child support, they'll go through all hoops possible to avoid it.
 
This is what I'd like the state to do. Throw his sorry a$$ into jail, put him on a chain gang and make him work for 47 cents an hour. I bet 6 months of that and he would be more than willing to work a regular job and pay support. I know people on both sides abuse the system but his family has a 5 million dollar trust and he wants for nothing while my child is scraping by. The system sucks! If single parents became a voting voice unto themselves legislation would change! :(
 
It is a disgrace that these men can get away with not supporting their children. .

what kind of life does your daughter's father really have. He can't drive , he doesn't support hisself . Don't you imagine he is one miserable SOB? If I were a man I wouldn't want to live if I didn't support my children.

He may think he is living high on the hog but it will catch up with him someday.So hang in there . Keep doing what you are doing. And call CSE every week to ask if there is any thing new. Keep your case fresh.

I think the lein process in my state Missouri can take up to a year..but the AG office does send out some letters that should put the fear of God in man.This might be what it takes to get him to work.

Do you know anything about his families' trust? Talking to an attorney might be very helpful to you, because if he is in any way entitled to any of the trust money, a lawyer may be able to get some of that for you. Does the state know about the trust?
It must be so frustrating for you to know that him and his family has soo much money and HIS KIDS aren't getting any support at all. I wish you luck.

Please explain how the court can put a lein on a person. A lein can be placed on bank accounts, property, etc., not an actual person.

Likely you got a judgement against him, not a lein.

I am going through the same thing with my ex, except he is working (owns his own business). His parents also help him get away with not paying, infact so does his sisters. We have tryed everything to get any money out of him. He doesn't have a business license, so the state can't track him, and frankly they make it impossible to get anything. It is sad to say but the best thing you can do is just not count on getting anything directly from him. I would check into the trust thing, it might be the only way you get anything. I think every state needs to take a better look at the laws,(I live in Utah) suspending a drivers lisence doesn't work!!! My ex has had his suspended and big deal, still no money for our three kids. Being single has nothing to do with this. As an American citizen, you should be registered to vote and use that right every Election Day. YOU have the power even without waiting until Election Day. What's holding you back from writing your State Representatives?

You know -- the ones YOU voted for who should be working FOR YOU?! The system is far from perfect and it screws people who are not only in your position.

If you want change, then write to those in your state who have the power to address it. Tell them what's wrong and suggest to them how it should be fixed. Remember YOU voted for them. They ARE replaceable (too bad people don't think of that when they vote instead of voting Republican or Democrat).

As a matter of fact I am a registered voter and I vote in every city, county, and state election as well as federal elections. I have written to my district representatives and my state representatives but to no avail. I guess there is not enough "big money" in child support so it is an issue that goes unaddressed. If parents united we could make it an issue but still it would be an election issue and once the election is won it would soon disappear until the next election.

As far as the family trust goes all I know is what I could find out from county recorders office. He is not listed as a beneficiary but he and his parents live in a $250,000 home. I may get lucky though. He is curerently on trial for pulling a gun on the utility meter reader back in Feb. With any luck the petition for contempt will go through before his criminal case is over and maybe I can get him picked up at the court. The last purge was $1000 and his parents had him out in less than 24. ;)

Glad to see you've written to those Representatives.:) It's not a matter of it being a "big money" issue, it's a matter of it not being a very attractive issue for any representative to take on. Look at your State Reps and look at some of the ridiculous crap they spend their time trying to pass. Changing the current child support system in any state is not very popular and those who would forward bills and proposals to change it don't want to deal with the criticism and attacks they'd get from groups that have absolutely no interest in the system itself. They're just interesting in getting their voices heard to fulfill their agenda.

And those groups I am talking about are women's rights group. It's not a biased statement because it's true. The facts are there...just look 'em up.

Have you tried networking with other individuals in your state? Have you written more than one letter (sans the emotion so it doesn't bury why you're writing)? Continue to put pressure on them IF you feel it's flawed. Keep in mind, what you think might be flawed might not be to others. Don't let them ignore you. IF they do, then make sure you don't vote for them when their term is up and they're up for re-election.
 
Ive written letters for the last nine years. The system doesn't seem to want to investigate each case individually. I only got food and medical benefits from the state so they have no motive to put effort into my case. It is not their money. I have looked into those services that claim to collect for you but they want 33% of the arears and 25% of all future funds collected so I will wait a few years before resorting to that solution not that they can get blood out of a turnip. Seems they only way I'll get a cent is if mommy and daddy pay the next purge, if their is one. :(
