Can a seller claim to have been unaware that they passed off a Not Actual Mileage Title as an Actual Mileage Title?

Two weeks ago, I purchased a 95 VW Jetta from a private seller. It was advertised as having 28k original miles. On the back of the title, the seller checked the box claiming that it was an Actual Mileage Title. Shortly after the purchase, I realized that it was in fact a Not Actual Mileage Title. The odometer in the vehicle had most likely been replaced. I am conviced that the seller was well aware of the milage discrepency.

I've been investigating the vehicle history, and it appears that the seller purchased the car from a tow company, fixed up the body a bit, and resold the car to me. When the seller signed the back of the title from the tow company, the box claiming that it was a Not Actual Milage title was clearly checked. Furthermore, the odometer reading on the front of the tow company title read 1 mile in 2004. Is this enough evidence to nullify the sale of the vehicle? What should be my next course of action in getting a refund of the sale? Can I file a criminal suit against them? Thank you very much for any help.

The evidence you described may be enough to nullify the sale, but only a judge can decide that. Your next step should be to contact the DMV to find out if they can help you, or what they recommend you do. You may have to file a small claims case against the other party to get your money back. You can only file a civil suit, not a criminal suit.
